第1条（総則）

本利用規約（以下「本規約」）は、当社が提供するAliGetter（以下「本ソフトウェア」）の利用に関する条件を定めるものです。本ソフトウェアをダウンロード、インストール、または使用することにより、お客様は本規約に同意したものとみなされます。

第2条（サービス内容）

本ソフトウェアは、AliExpressから商品情報を取得し、CSVファイルを出力する機能を提供します。
本ソフトウェアはGoogle Chrome等のブラウザで動作する拡張機能アプリケーションです。

第3条（利用料金・支払い）

無料試用期間：初回利用から30日間無料でご利用いただけます。
有料プラン：無料試用期間終了後は月額制の有料プランへの移行が必要です。
決済方法：Stripeを通じて決済を行います。
返金：一度お支払いいただいた料金の返金は原則として行いません。

第4条（ライセンス・利用制限）

本ソフトウェアは利用ライセンスを付与するものであり、所有権の移転は行いません。
Googleアカウントによる認証が必要です。
1つのライセンスにつき1つのGoogleアカウントでのみ利用可能です。
本ソフトウェアの再配布、転売、リバースエンジニアリング、逆コンパイルは禁止します。

第5条（個人情報の取り扱い）

収集する情報：
・アカウント認証のための基本情報
・Stripe決済に関連する情報
・ソフトウェア利用状況の統計情報

利用目的：
・ライセンス管理および認証
・決済処理
・サポート提供
・サービス改善

第三者提供：
法令に基づく場合を除き、お客様の同意なく第三者に提供することはありません。

第6条（自己責任・免責事項）

重要な注意事項：
・本ソフトウェアの利用は、お客様の完全な自己責任において行うものとします
・AliExpressの利用規約・サービス規約の範囲内でのみご利用ください
・AliExpressとのトラブルについては、当社は一切の責任を負いません
・本ソフトウェアを利用して取得したデータ・画像・コンテンツの使用に関するあらゆる問題・トラブル・損害については、お客様自身の責任において対処するものとします
・本ソフトウェアの使用によりお客様のAliExpressアカウントが制限・凍結・停止（BANを含む）された場合であっても、当社は一切の責任を負いません。AliExpressのスクレイピングポリシーや利用規約への準拠・遵守はお客様の完全な自己責任となります

⚠️ 画像・コンテンツの取り扱いに関する重要事項：
・本ソフトウェアにより取得・ダウンロードされる画像および商品説明等のコンテンツは、市場調査・商品リサーチ目的に限り使用するものとします
・取得した画像や商品説明を自社のECサイト・SNS・その他媒体に転載・掲載する場合は、著作権者および権利者に事前に確認・許諾を得てください
・AliExpressの各販売者・メーカー等が保有する画像や商品説明の著作権・知的財産権は、それぞれの権利者に帰属します
・権利者の許諾なく画像や商品説明を商用目的で無断使用した場合、著作権侵害等の法的問題が生じる可能性があります。十分にご注意ください
・本ソフトウェアはデータ取得の自動化ツールにすぎず、取得したコンテンツの商用利用の適否についての判断はお客様ご自身の責任において行うものとします

免責事項：
・本ソフトウェアの利用により生じたいかなる損害についても、当社に故意または重過失がある場合を除き、当社は責任を負いません
・AliExpressのサイト仕様変更により機能が使用できなくなった場合でも、返金は行いません
・データの正確性や完全性については保証いたしません
・第三者のウェブサイトやサービスとの連携に関する問題については責任を負いません
・取得した画像・コンテンツの著作権侵害、商標権侵害、その他知的財産権に関するトラブルについて、当社は一切の責任を負いません
・本ソフトウェアを利用して取得した画像・情報の使用に起因する第三者からの請求、訴訟、損害賠償請求等について、当社は一切免責とします
・お客様が本規約に違反して画像・コンテンツを使用したことにより生じた損害・不利益について、当社は補償・賠償の義務を一切負いません

賠償責任の上限：
当社の過失によりお客様に損害が生じた場合であっても、当社の賠償責任は、損害発生時点においてお客様が直近1ヶ月間にお支払いいただいた利用料金の金額を上限とします。なお、間接損害・逸失利益・特別損害については、当社に故意または重過失がある場合を除き、当社は一切責任を負いません。

第7条（禁止事項）

お客様は以下の行為を行ってはならないものとします：
・AliExpressの利用規約に違反する行為
・過度なアクセスによりAliExpressのサーバーに負荷をかける行為
・本ソフトウェアを商用目的で第三者に提供する行為
・違法な目的での利用
・他者の権利を侵害する行為
・公序良俗に反する行為
・取得した画像・商品説明等のコンテンツを、著作権者・権利者の許諾なく商用目的で無断転載・使用する行為
・市場調査・リサーチ以外の目的での大量の画像・コンテンツの複製・配布行為
・AliExpressの販売者・メーカー等の知的財産権を侵害するおそれのある行為

第8条（サービス停止・アカウント停止）

以下の場合、事前通知なくサービスの提供を停止することがあります：
・本規約違反が発覚した場合
・決済が正常に行われない場合
・AliExpressからの要請があった場合
・その他、当社が不適切と判断した場合

第9条（知的財産権）

本ソフトウェアに関する著作権、特許権、商標権等の知的財産権は当社に帰属します。

第10条（サポート）

基本的な技術サポートを提供しますが、24時間365日の対応は保証いたしません。
Aliexpressの仕様変更に伴う問題については、可能な範囲で対応いたしますが、対応を保証するものではありません。
アップデートを行った場合は、登録のメールアドレスまたは拡張機能内にて案内を致します。

第11条（規約の変更）

当社は、必要に応じて本規約を変更することがあります。変更後の規約は、当社ウェブサイト等で公表した時点で効力を生じます。

第12条（準拠法・管轄裁判所）

本規約は日本法に準拠します。
本規約に関して紛争が生じた場合は、当社所在地を管轄する地方裁判所を第一審の専属的合意管轄裁判所とします。

第13条（その他）

本規約の一部が無効または執行不能と判断された場合でも、残りの部分の有効性には影響しません。
当社から利用者への通知は、登録されたメールアドレス等への送信をもって行います。

Article 1 (General Provisions)

These Terms of Service (hereinafter "Terms") define the conditions for using AliGetter (hereinafter "Software") provided by our company. By downloading, installing, or using the Software, you are deemed to have agreed to these Terms.

Article 2 (Service Details)

The Software provides a function to acquire product information from AliExpress and output CSV files.
The Software is an extension application that runs on browsers such as Google Chrome.

Article 3 (Usage Fees and Payment)

Free Trial Period: You can use the software for free for 30 days from the first login.
Paid Plan: After the free trial period ends, you need to transition to a monthly paid plan.
Payment Method: Payments are made through Stripe.
Refunds: In principle, we do not provide refunds for fees once paid.

Article 4 (License and Usage Restrictions)

The Software grants a usage license and does not transfer ownership.
Authentication via Google Account is required.
Only one Google account can be used per license.
Redistribution, resale, reverse engineering, and decompilation of the Software are prohibited.

Article 5 (Handling of Personal Information)

Third-party Provision:

・We are not responsible for any trouble with AliExpress
・You are solely responsible for handling any issues, disputes, or damages arising from your use of data, images, or content obtained through the Software
・We bear no liability whatsoever if your AliExpress account is restricted, frozen, suspended, or banned (including permanent bans) as a result of using the Software. Compliance with AliExpress's scraping policies and Terms of Service is entirely your own responsibility

⚠️ Important Notice Regarding Images and Content:
・Images and content (including product descriptions) downloaded via the Software shall be used solely for market research and product research purposes
・If you intend to post or reuse acquired images or product descriptions on your own EC site, SNS, or other media, please obtain prior confirmation and permission from the copyright holder or rights owner
・The copyrights and intellectual property rights of images and product descriptions held by each AliExpress seller, manufacturer, or brand remain with their respective rights holders
・Unauthorized commercial use of images or content without permission from the rights holder may constitute copyright infringement or other legal violations. Please exercise due caution
・The Software is merely a tool for automating data retrieval. The judgment of whether the obtained content may be used commercially is entirely the responsibility of the user

DISCLAIMER:
・EXCEPT IN CASES OF OUR INTENTIONAL MISCONDUCT OR GROSS NEGLIGENCE, WE ARE NOT RESPONSIBLE FOR ANY DAMAGE CAUSED BY THE USE OF THE SOFTWARE.
・REFUNDS WILL NOT BE PROVIDED EVEN IF THE SOFTWARE BECOMES UNUSABLE DUE TO ALIEXPRESS SPECIFICATION CHANGES.
・WE DO NOT GUARANTEE DATA ACCURACY OR COMPLETENESS.
・WE ARE NOT RESPONSIBLE FOR PROBLEMS REGARDING COORDINATION WITH THIRD-PARTY WEBSITES OR SERVICES.
・WE BEAR NO RESPONSIBILITY WHATSOEVER FOR ANY DISPUTES RELATED TO COPYRIGHT INFRINGEMENT, TRADEMARK INFRINGEMENT, OR OTHER INTELLECTUAL PROPERTY RIGHTS CONCERNING IMAGES OR CONTENT OBTAINED THROUGH THE SOFTWARE.
・WE ARE FULLY INDEMNIFIED FROM ANY CLAIMS, LAWSUITS, OR DEMANDS FOR DAMAGES FROM THIRD PARTIES ARISING FROM YOUR USE OF IMAGES OR INFORMATION OBTAINED THROUGH THE SOFTWARE.
・WE BEAR NO OBLIGATION TO COMPENSATE OR INDEMNIFY FOR ANY DAMAGES OR DISADVANTAGES ARISING FROM A USER'S VIOLATION OF THESE TERMS REGARDING IMAGE OR CONTENT USE.

LIMITATION OF LIABILITY:
EVEN IN CASES WHERE OUR NEGLIGENCE CAUSES DAMAGE TO YOU, OUR TOTAL LIABILITY SHALL BE LIMITED TO THE AMOUNT OF USAGE FEES YOU PAID IN THE MOST RECENT ONE-MONTH PERIOD PRIOR TO THE OCCURRENCE OF THE DAMAGE. WE SHALL BEAR NO LIABILITY FOR INDIRECT DAMAGES, LOST PROFITS, OR SPECIAL DAMAGES, EXCEPT IN CASES OF OUR INTENTIONAL MISCONDUCT OR GROSS NEGLIGENCE.

Article 7 (Prohibited Acts)

Customers shall not perform the following acts:
・Acts that violate AliExpress's Terms of Service
・Putting an excessive load on AliExpress's servers through excessive access
・Providing the Software to third parties for commercial purposes
・Use for illegal purposes
・Acts that infringe on the rights of others
・Acts contrary to public order and morals
・Unauthorized commercial reposting or use of obtained images, product descriptions, or other content without permission from the copyright holder or rights owner
・Mass reproduction or distribution of images and content for purposes other than market research
・Any acts that may infringe upon the intellectual property rights of AliExpress sellers, manufacturers, or brands

Article 8 (Service Suspension & Account Suspension)

We may suspend the provision of the Software or your AliGetter account without prior notice in the following cases:
・Violation of these Terms is discovered
・Payment is not made correctly
・Request from AliExpress
・Cases where we judge it inappropriate

Article 9 (Intellectual Property Rights)

Intellectual property rights such as copyrights, patent rights, and trademark rights regarding the Software belong to our company.

Article 10 (Support)

Basic technical support is provided, but 24/7 availability is not guaranteed.
We will respond to problems associated with AliExpress specification changes within reasonable limits, but do not guarantee a response.
Updates will be announced via registered email or within the extension.

Article 11 (Changes to Terms)

We may change these Terms as necessary. Changed Terms become effective when announced on our website, etc.

Article 12 (Governing Law & Jurisdiction)

These Terms are governed by Japanese law.
If a dispute arises regarding these Terms, the district court having jurisdiction over our location shall be the exclusive agreed court of first instance.

Article 13 (Others)

Even if part of these Terms is judged invalid or unenforceable, the effectiveness of the remaining parts shall not be affected.
Notifications to users will be made by sending to the registered email address, etc.
These Terms are executed in Japanese. If there is any discrepancy or conflict between the Japanese version and any translated version (including this English version), the Japanese version shall prevail.
